He was in charge of a prison van which was transporting Fenian Prisoners, from Manchester Court to Belle Vue Prison. As the vehicle reached the railway bridge that crosses Hyde Road, it was attacked by a group of armed sympathisers, who demanded the release of the prisoners. Sergeant Brett refused to hand over the keys of the vehicle and was shot and killed.
